Former Florida QB commit who had scholarship revoked for saying N-word offered by HBCU
Former Florida quarterback commit Marcus Stokes, who had his offer revoked by the university after being caught on video rapping the N-word, has received a new offer from Albany State University, a HBCU (Historically Black College and University) in Georgia.
Stokes is a 4-star commit in the Class of 2023 and was committed to Florida until Nov. 20 when the incident came to light.

Stokes is also receiving interest from West Florida, a DII university near Pensacola.
He is currently considered to be the No. 24 quarterback in the 2023 cycle according to 247Sports’ composite rankings and was originally committed to Penn State before flipping to Florida.

Obviously, the kid doesn’t want to burn down his football future, but he has a textbook case of 1st amendment violation of free speech. UF is a government institution.
No government suppressed his speech. He can continue to sing whatever songs he wants to.
Captain Q, a government institution (UF) took away his opportunity to advance his education and possible future pro football career for uttering a politically incorrect word. That can have very damaging financial consequences to his life. You bet he has grounds to sue them for that.

Not familiar with that incident Captain, but it sounds like it has potential. Keep in mind, given how things work in the professional ranks these days, such a lawsuit will get him blacklisted for life.
Actually, gentlemen, from a purely legal standpoint, a first amendment claim here is not so clear-cut.
He has a right to say whatever he pleases, and the fact that he said what he did off-campus mitigates in his favor. But three things mitigate against him.
The first is that he had no right to the scholarship; the school did not take it from him, they just didn’t give it to him. It was within their discretion to withhold a scholarship not yet awarded, for any reason, or for no reason at all.
The second is that scholarship contracts can typically be revoked for violations of the applicable student code of conduct. Provable utterances of racial slurs violate student codes of conduct.
The third is the Supreme Court’s 1969 Tinker decision, which, were he to overcome the hurdles above, would still give school officials the right to penalize him if they could reasonably foresee disruption to university activities and/or harm to other students as a result of his statement.
A Tinker argument would turn on specific circumstances and he might be able to make an argument in his favor. But on the first two points, his lawsuit would likely not survive a motion to dismiss.

All the same, this could be a test case for whether leftist public institutions that benefit from government largess can control what members of a disfavored social group can utter publicly under threat of diminishing their future livelihood if they don’t tow the “party line.”
The kid would have to throw away what’s left of his diminishing football future and find very sharp constitutional lawyers willing to work on his case for years, pro bono. Both of those are equally unlikely.

First Amendment torts seem to get more traction in secondary educational settings, though state dependent.
I haven’t heard the video and I do agree that context matters but this is not a free speech thing, no one stopped him from saying anything or artistically expressing himself. It’s more of a reactionary or disregard for context issue that is happening in our country.
He sang along with a wrap song on his car radio. He repeated a “verboten to him word” in sync with the wrap singer on his car radio. He recorded himself doing it and posted his recording on social media.
That constitutes free expression and publication of his “artistic interpretation” of a pubic song.
For that “transgression” against political correctness, a government institution (UF) withdrew his scholi offer and all the other FBS institutions have failed to extend him another offer, despite the fact he’s a 4-star HS QB.
He has an open-and-shut financial damages caused by a free speech violation claim against UF, a government funded institution.
The heart of the first amendment is that no government institution may deny anyone’s right to sing in public.
It is clear to all of us. Unfortunately, his success in court is unlikely given the current state of affairs.

Fromchaos, his success in federal court may ultimately be quite good, since any jury decision would be appealed to the SCOTUS, where he’s likely to win.

The reaction to something like this is swift and absolute. Regardless of scenario in which it occurred. Given the circumstances, I don’t know what the kid really did wrong. Not directed at anyone, no hateful intent, literally just repeating the lyrics. Oh well, I haven’t understood how we got to this place, but just find myself now afraid to say anything. Super weird time to be alive.

Go to the Gators Summer practices, you will hear the “n word” blasted from the practice field speakers every few seconds. I imagine if you go into the locker room you will also hear the word thrown around quite freely.

Looks as if that is not so serious of a transgression after all. I fail to understand why that isn’t a unexcusable thing under ANY circumstances. Either it is or it isn’t – if one thinks it is OK under certain conditions then it should be OK under others.
In a constitutional republic, it is in fact protected speech. However, that idea is apparently obsolete in post-modern times in favor of this instead being a ‘democracy’. It is within the latter concept that a constitution is seldom applied and you witness the arrival of protected groups, often under the conditions of immutable characteristics …. but not exclusively so ….. with freedom of speech being abridged at will by those with the most power. That this is accepted by the actual majority of citizens itself speaks volumes.
